These Terms of Service ("Terms") govern your use of EcomKings' website and services. By accessing ecomkings.com or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
EcomKings provides done-for-you email marketing services for ecommerce businesses, including email flow strategy, copywriting, design, list management, campaign execution, and ongoing optimization ("Services").
You must be at least 18 years old and authorized to enter into binding agreements on behalf of your business to use our Services.
EcomKings offers a results-based guarantee as described during the sales process. The specific terms of any guarantee are outlined in your service agreement. Results may vary based on your list quality, industry, and business.
Service fees are agreed upon during onboarding and outlined in your service agreement. Payment terms, billing cycles, and any performance-based compensation are specified therein. All fees are due as specified in your agreement.

By using our Services, you grant EcomKings a limited license to access your email platform, customer data, and brand assets solely to perform the Services on your behalf. We will not use your data for any other purpose without your written consent.

All content, copy, and creative assets produced by EcomKings on your behalf become your property upon full payment. EcomKings retains the right to reference your results as a case study unless you request otherwise in writing.
Both parties agree to keep confidential any non-public business information shared during the engagement. This obligation survives termination of the Services.
The Services are provided without warranty of specific revenue outcomes. While we stand behind our work with a performance guarantee (per your agreement), we cannot guarantee specific results as they depend on factors outside our control.
To the maximum extent permitted by law, EcomKings shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the fees paid by you in the three months preceding the claim.
You agree to indemnify and hold EcomKings harmless from any claims arising from your use of the Services, your content, or your violation of these Terms.
We may update these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of West Virginia, without regard to conflict of law provisions.
